Agreeing to these terms
These terms are an agreement between you and Prarthan Agarwal, who creates and operates Pinky Promise ("we", "us"). By downloading or using the Pinky Promise app or this website, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Pinky Promise.
Who can use Pinky Promise
You must be at least 13 years old. If you're under the age of majority where you live, you need a parent or guardian's permission, and they agree to these terms on your behalf. You also need a compatible iPhone and must follow Apple's terms for your device and Apple ID.
What Pinky Promise is, and isn’t
Pinky Promise is a voluntary accountability tool. It uses Apple's Screen Time frameworks to help you keep promises about the apps you choose, on your own or with another person.
- It isn't a monitoring or parental-control service. It must never be used to watch, control or pressure someone who hasn't freely agreed.
- It isn't an emergency or safety service. Don't rely on it where your health, safety or someone else's depends on it. If you're in danger, contact local emergency services.
- It can't be guaranteed. The device owner can always turn off Screen Time access, delete the app or change their iPhone. Enforcement depends on Apple's software, which may change or fail.
Accounts
Solo promises don't need an account. Shared promises need Sign in with Apple. You're responsible for activity on your account and for keeping your iPhone and Apple ID secure. Tell us right away at hey.prarthan@gmail.com if you think someone else is using your account. You can delete your account at any time in the app.
The Shared plan and payments
Solo promises are free. Shared promises need an active Shared plan, which is an auto-renewing subscription sold through Apple's App Store. One active plan, bought by either person, covers both people in the pair.
- Prices, billing periods and any free trial are shown in the app before you buy. Trial eligibility is decided by Apple.
- Payment is charged to your Apple ID. The subscription renews automatically unless you cancel it at least 24 hours before the current period ends.
- Manage or cancel your subscription in the Settings app under your Apple ID, then Subscriptions. Deleting the app or your Pinky Promise account doesn't cancel it.
- Refunds are handled by Apple under its policies. You can restore a purchase from the app.
- If a Shared plan ends, the partnership and existing promises stay visible, but new shared promises need an active plan. Ending a promise, unpairing, deleting your account and restoring purchases always remain free.
We may change prices or plan features in the future. Apple will tell you about price changes as its rules require.
Acceptable use
You agree not to:
- Use Pinky Promise to harass, threaten, coerce, stalk or control anyone.
- Pair with someone without their knowledge or on a device that isn't yours.
- Send unlawful, hateful, sexual or abusive content in reasons or messages.
- Try to get around security, access other people's data, or interfere with the service.
- Copy, reverse engineer or resell the app, except where the law allows it.
- Use Pinky Promise in a way that breaks the law or Apple's terms.
Your content
You keep ownership of what you write in Pinky Promise, such as names, reasons and messages. You give us permission to store, process and show that content only as needed to run the service for you and your partner. We don't use it for advertising.
Our app and brand
Pinky Promise, its design, characters, artwork and software belong to us or our licensors. We give you a personal, non-transferable licence to use the app on Apple devices you own or control, as allowed by these terms and Apple's Usage Rules.
Apple and other services
Pinky Promise relies on services from Apple and other providers, which have their own terms. We aren't responsible for those services.
These terms are between you and us, not Apple. Apple isn't responsible for the app, its content, maintenance or support, or for handling any claims about it, including product liability, legal compliance or intellectual property claims. If the app fails to meet any applicable warranty, you may tell Apple, and Apple may refund the purchase price, if any; Apple has no other warranty obligation for the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Ending your use
You can stop using Pinky Promise at any time and delete your account in the app. We may suspend or end access if you break these terms, if we need to protect someone's safety, or if we stop offering the service. Where reasonable, we'll let you know first.
Disclaimers
Pinky Promise is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including that the app will be uninterrupted, error-free, or will always enforce a promise. Nothing in these terms limits rights you have under consumer laws that can't be excluded.
Limitation of liability
To the fullest extent the law allows, we aren't liable for indirect, incidental, special or consequential losses, or for lost data, time or opportunities, arising from your use of Pinky Promise. Our total liability for any claim is limited to the amount you paid for Pinky Promise in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you.
Changes to these terms
We may update these terms as Pinky Promise changes. We'll update the date at the top of this page, and for significant changes we'll take reasonable steps to tell you, such as a notice in the app. Continuing to use Pinky Promise after a change means you accept it.
